Advocating for Medical Psilocybin Regulations in Canada

Help Us Legalize Therapeutic Psilocybin in Canada

Psilocybin-assisted psychotherapy is the professionally guided use of psilocybin (magic mushrooms) in combination with psychotherapy and differs greatly from the recreational use of psychedelics. This clinically tested treatment program encompasses careful medical oversight of the medicine session, as well as intention setting and integration psychotherapy sessions (without psilocybin) that help prepare an individual for lasting healing.

Psilocybin therapy for palliative care and treatment-resistant health conditions (treatment-resistant depression, post-traumatic stress disorder, substance use disorders, cluster headaches, etc..)  is a safe, compassionate, effective, and reasonable treatment option for Canadians in medical need that has been proven by rigorous clinical research studies and confirmed by real-world anecdotal evidence.

What problems are patients facing?

Over 37 Canadians in medical need, supported by TheraPsil, have received approved section 56 exemptions from Federal Health Minister, Patty Hajdu allowing them to legally use, possess, and transport psilocybin in the context of psilocybin therapy. Unfortunately, there are many more Canadians, equally suffering who have been waiting months for a response from the Minister.

Section 56 exemptions, where the Minister of Health grants individual exemptions for psilocybin use to patients on a case-by-case basis, while beneficial to open the door to compassionate access over the past year, is not a sustainable model to offer healthcare. When some patients are approved for this treatment option, and others are not, it is clear: section 56 exemptions are arbitrary, discriminatory, and infringe upon patients section 15 charter rights

What is the solution?

Canada urgently needs a change in regulations that would allow medical psilocybin and psilocybin therapy to be accessible through consultation between a patient and their healthcare provider, not through case-by-case exemptions granted by the Federal Minister of Health.

In August 2021, TheraPsil, in consultation with patients, lawyers, and policy experts has drafted a proposed framework for medical psilocybin in Canada. Now, we are asking for public consultation on these regulations so that amendments to this first draft can be made, reflecting the feedback of stakeholders, and a second draft can be delivered to the Federal Minister of Health, and Health-Canada, post-September 20th, 2021 election.

Politicians Who Support Legal Access to Medical Psilocybin

Hi [ candidate's name ]

I am a constituent in your riding and I am considering who I will be voting for in the upcoming election.

Issues that are important to me are increased resources for innovative mental health treatment options and progressive drug policies.

I am a supporter of the National non-profit organization, TheraPsil. TheraPsil is a Canada-wide patient advocacy group dedicated to changing public policy regarding psilocybin-assisted therapy.

Here are some quick facts regarding psilocybin-assisted therapy, and TherPsil, in Canada:

  • Research has shown psilocybin-therapy to be a safe, effective treatment option for many treatment-resistant mental health conditions including end-of-life distress, cancer anxiety, treatment resistant depression, PTSD etc.
  • As of a July 2021 poll, 66% of Canadians are in favour of the regulation change that would allow psilocybin to be medically available with doctors support.
  • Over 37 patients across Canada now have legal access to psilocybin-assisted psychotherapy, granted by Minister Patty Hajdu through section 56 exemptions, while hundreds of other patients with treatment resistant health conditions, as well as those dying from a terminal illness, await a response.
  • Patients and Doctors are currently fundraising to go to federal court to gain access to psilocybin for medical purposes.

As a constituent in your riding, I am considering which MP candidate I will vote for based on the representative who will be able to represent my interests to federal ministers and in Parliament. As such, I am kindly requesting your participation in a short survey (less than 5 minutes) regarding your stance on psilocybin-assisted therapy in Canada and medical psilocybin legalization.

Please click here to access the survey, hosted on Google Forms.

I deeply appreciate your time regarding this urgent matter.

Warm regards,

Step 3) Follow TheraPsil on Twitter, Instagram and Facebook to stay up to date on which candidates have answered the survey, and for their stance on medical psilocybin regulations.

Step 4) Attend an 'All Candidates Meeting'.

Many ridings will host 'all candidate meetings' where constituents have the opportunity to ask questions of all the candidates in their riding. If you have the time and energy to attend these meetings for your riding, you can use the above email template and survey questions as a loose script for engaging your candidates on this topic. If you end up going to one of these meetings and asking about psilocybin therapy, please share with us what the candidates say, on social media or by emailing us.

The easiest way to find out if there is an upcoming 'all candidate's meeting' in your riding is by Googling "All candidate's meeting {the name of your riding} 2021", reading your local paper which should announce these meetings or by contacting your candidate's and asking directly.

If you have any issues finding your candidate's contact information or need assistance, please email our Director of Communications, Holly ( for support.

For example, if you are someone who could benefit from psilocybin therapy, or who has already benefited from this treatment option, you may want to personalize then add in the following paragraph:

I am a (Patient age and diagnosis, stage of diagnosis, life expectancy/prognosis). I also suffer from serious psychological distress (add symptoms such as depression, anxiety, etc. if applicable) as a result of my disease and diagnosis. I have tried a number of treatments for my psychological distress, including (Add a few of the treatments that you have tried) but they have all proved unsuccessful. I have now lost confidence that any conventional treatment will help me. I feel my best option is to use psilocybin within the structured framework of a psychedelic psychotherapy program, with the support of my healthcare provider. I will only be able to legally access psilocybin therapy if medical regulations are made.
